    Welcome to Actuall! These Terms and Conditions (“Terms”) govern your access to and use of the Actuall mobile application (“App”), its features, and related services (collectively, “Service”). By downloading, accessing, or using Actuall you agree to these Terms, which form a legally binding agreement between you and Tunenexus Private Limited (“Company,” “Actuall,” “we,” or “us”). If you do not agree with these Terms, please do not use the Service.

    1. Eligibility

    • You must be at least 18 years old to register for or use Actuall.
    • You must provide accurate and complete information during registration, including your date of birth and phone number.
    • You agree to update your information promptly if it changes.

    2. Account Registration and Security

    • You are responsible for maintaining the confidentiality of your account login details and any activity occurring under your account.
    • You agree to notify us immediately of any unauthorized use or security breach of your account.

    3. User Conduct and Content

    • Genuine Interaction: Actuall is designed for creative, humorous, and authentic engagement.
    • You agree not to:
      • Post or transmit sexually explicit, abusive, or inappropriate content.
      • Impersonate others or create fake accounts.
      • Discriminate on the basis of race, gender, religion, etc.
      • Share personal contact info outside permitted areas.
      • Spam or use Actuall for commercial purposes without permission.
      • Violate any applicable laws.

    User-Generated Content: You are solely responsible for all content (“Content”) you create or share. By submitting Content, you grant us a non-exclusive license to use, moderate, and promote it. We may remove or moderate any Content that violates these Terms.

    4. Safety, Moderation, and Reporting

    • Users can report or block inappropriate behavior.
    • Reports are reviewed manually and action may be taken.
    • Tunenexus holds the right to suspend or remove accounts.

    5. Payments, Subscriptions, and Refunds

    • Some features may require payment or subscription.
    • Payments are processed by app stores and subject to their refund policies.
    • Pricing and features may change with notice.

    6. Privacy and Data Usage

    We collect and use data as described in our Privacy Policy. This includes your name, contact info, location data, and submitted content.

    Your data is securely stored and never sold.

    7. Intellectual Property

    • Actuall’s branding and content are owned/licensed by Tunenexus Private Limited.
    • Your use of Actuall must follow copyright and trademark laws.
    • Users retain ownership of their content but grant Actuall limited use rights.

    8. Account Termination

    • You can delete your account anytime via the app.
    • We may suspend accounts for violations or abuse.
    • Terminated data will be deleted as per our privacy practices.

    9. Disclaimers and Limitation of Liability

    Actuall is provided "as-is" without warranties. Tunenexus is not liable for user behavior, emotional harm, or disputes.

    10. Indemnity

    You agree to indemnify Tunenexus Private Limited, its affiliates, officers, and employees against claims, damages, and liabilities arising from your use of Actuall.

    11. Changes to These Terms

    We may update these Terms. Changes will be reflected in the app or via email, and continued use means acceptance of updated Terms.

    12. Governing Law and Dispute Resolution

    These Terms are governed by the laws of India. Disputes shall be subject to the courts of Delhi, India.
